These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Westside Security Inc, DBA Alpine Safes (“Company“, “we”, “us”, or “our”), concerning your access to and use of the https://alpinesafes.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

The Site is intended for users who are at least 18 years of age. Users under the age of 18 must have the permission and direct supervision of a parent or guardian.

Intellectual Property Rights

The Site is our proprietary property, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.

You are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. Any unauthorized use of the Content or Marks is strictly prohibited.

User Representations

By using the Site, you represent and warrant that:

  • You are at least 18 years old and have the legal capacity to agree to these Terms.
  • You will comply with these Terms of Use and will not use the Site for any unlawful or unauthorized purpose.
  • You will provide accurate and current information if prompted to submit details, such as during checkout or account creation.

If you violate these representations, we reserve the right to suspend or terminate your use of the Site.

Products

We strive to accurately describe and display our products. However, we cannot guarantee that all colors, details, and specifications are completely error-free, as some factors (like monitor display settings) may affect how products appear.

All products are subject to availability. We reserve the right to discontinue products or make adjustments to pricing at any time without prior notice.

Purchases and Payment

We accept all major credit cards, ACH payments, and payments via invoice (for directly emailed customers). Payments will be billed at the time of purchase. If additional services are approved by the customer, they will be billed separately.

We use Helcim for credit card processing and take all reasonable steps to protect your financial information. For payment security details, please refer to Helcim’s policies.

You agree to provide current and accurate payment and contact information. If discrepancies arise, we reserve the right to cancel or refuse orders.

Returns and CReturns and Cancellation Policy

General Policy:
All safes are non-refundable and non-returnable once the customer has signed the proof of delivery confirming receipt of the safe in good condition. By signing the delivery confirmation, the customer agrees that the product was delivered as ordered and accepts responsibility for the item.

Exceptions:
We may, at our sole discretion, make exceptions to this policy on a case-by-case basis. If an exception is granted:

  • A restocking fee (percentage to be determined) will apply.
  • The customer is responsible for all shipping costs, including the cost to return the item to our facility.

Return Requests:
If you believe your situation qualifies for an exception, please contact us within 7 days of delivery at info@alpinesafes.com or (877) 587-7333. Be prepared to provide details about the condition of the safe, photos (if applicable), and an explanation of your request.

Damaged Items:
If your safe is damaged upon delivery, do not sign the proof of delivery. Instead, notify the delivery driver immediately, take photographs of the damage, and contact us right away to file a claim. We cannot honor claims for damage once the proof of delivery has been signed.

Restocking Fee:
Restocking fees are determined based on the type of safe, its condition upon return, and associated handling costs.

Prohibited Activities

You may not access or use the Site for any purpose other than what is explicitly permitted. Specifically, you are prohibited from:

  • Engaging in spamming, hacking, or any other malicious activities.
  • Uploading harmful content (e.g., viruses or malware).
  • Harassing or abusing other users or our employees.
  • Tampering with or circumventing site security features.

We reserve the right to terminate access to the Site for any violations of these Terms.

The Site may contain links to third-party websites or services. These are provided for your convenience, but we are not responsible for their content, accuracy, or practices. Your use of such sites is at your own risk.

All disputes arising out of or related to these Terms of Use shall be resolved under the laws of New York, without regard to conflict-of-law provisions. Any legal proceedings must take place in North New Hyde Park, New York.

Disclaimer of Warranties and Limitation of Liability

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site, including loss of data, revenue, or profits. In no event shall our liability exceed $100.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages resulting from:

  • Your use of the Site.
  • Your violation of these Terms.
  • Your infringement of third-party rights (e.g., intellectual property).

Miscellaneous Provisions

These Terms of Use, along with any policies or legal notices posted on the Site, constitute the entire agreement between you and us. If any provision of these Terms is found to be invalid, the remainder will still apply.
